1Agreement
These Terms of Service ("Terms") are an agreement between you and Kre8ivHosting, LLC ("Kre8ivHosting", "we", "us"), a Texas limited liability company. They apply to our website, client area, hosting plans, domain registrations, add-ons and support (together, the "Services").
By creating an account, placing an order or using the Services, you agree to these Terms and to our Privacy Policy. If you accept on behalf of a business, you confirm you are authorized to bind it. You must be at least 18 years old.
2Your account
Keep your account details accurate, including a working email address. We send invoices, renewal notices and security alerts there.
You are responsible for activity under your account and for keeping passwords and two-factor codes private. Tell us right away if you think your account has been accessed without permission. Anyone you add as a user or contact can act within the permissions you give them.
3Services and orders
Each plan includes the resources and features described on the order page at the time you buy it, such as CPU, memory, storage and bandwidth. If a site consistently uses more than its plan allows, we will contact you to discuss an upgrade before taking any other step, unless the usage is harming other customers.
On managed plans we handle server maintenance, security patching, WordPress core updates and backups. Work on your own themes, plugins, code or content is outside the plan unless we agree to it in writing.
Some add-ons are provided by third parties, including SSL certificates, SiteLock, CodeGuard, 360 Monitoring, marketgoo, NordVPN, Professional Email and Google Workspace. Those products are also subject to their provider's terms.
4Billing and renewal
Services are billed in advance for the billing cycle you choose. They renew automatically at the then-current price unless you cancel before the renewal date. We email an invoice before each renewal, and if you have a saved payment method, we charge it on the due date.
If an invoice is unpaid:
- We send reminders before and after the due date.
- Services may be suspended once an invoice is 7 days overdue.
- Services may be terminated, and their data deleted, once an invoice is 30 days overdue.
- Domains that expire follow the registry's grace and redemption periods. Restoring a domain in redemption carries an extra fee.
Prices exclude taxes unless stated. You are responsible for any taxes that apply to your purchase.
5Cancellation and refunds
You can cancel any service from the client area. Cancellation takes effect at the end of the current billing period unless you ask for immediate cancellation. We don't refund partial periods.
Domain registrations, renewals and transfers, SSL certificates, and third-party licenses can't be refunded once processed, because we pay the registry or provider when you order.
6Uptime and service availability
No hosting provider can guarantee 100% uptime, and we don't claim to. Hardware fails, networks have problems, software needs patching and upstream providers have outages. What we can promise is how we run the platform:
- Hosting runs on shared AWS infrastructure. A host or upstream service failure may interrupt websites.
- Automated server checks help identify issues. Human response times depend on the incident and agreed support scope.
- Daily offsite backups, so we can restore a site if something goes wrong.
- Updates tested before rollout, and applied during low-traffic hours where possible.
- Planned maintenance announced at least 48 hours ahead on our network status page and by email when it may affect your service.
- Live incident updates on the network status page until service is fully restored.
Emergency maintenance, such as patching an actively exploited security flaw, may happen without advance notice. Enterprise plans can include a written service level agreement with service credits, set out in your order. Other plans don't include an uptime commitment or credits.
7Backups and your data
Daily backups are part of the managed service and are kept for the period described for your plan. Backups are a safety net, not a guarantee. You are responsible for keeping your own copy of any content, data or email you can't afford to lose.
After a service is cancelled or terminated, its data and backups are deleted on our normal schedule and may not be recoverable.
8Acceptable use
You agree not to use the Services, or let anyone else use them, to:
- Break any law or regulation, or infringe anyone's intellectual property or privacy.
- Send spam or unsolicited bulk email, or host phishing, malware or fraud.
- Host child sexual abuse material, or content that promotes violence against people.
- Attack, scan or probe other systems, or try to get around our security or resource limits.
- Mine cryptocurrency, run open proxies, or use resources in a way that degrades service for other customers.
If we find a violation, we may remove the content or suspend the service. Where the risk allows, we will contact you first and give you a chance to fix it.
9Your content
You keep all rights to the content you host with us. You give us permission to store, copy and serve it only as needed to provide the Services.
To report content that infringes your copyright, email [email protected] with the details required by the Digital Millennium Copyright Act. We respond to valid notices and remove infringing material.
10Suspension and termination
We may suspend or end Services for non-payment, a breach of these Terms, a legal requirement, or activity that threatens our network or other customers. When it is safe and lawful, we will tell you why and how to restore service. You can end this agreement at any time by cancelling your services and closing your account.
11Disclaimer of warranties
Apart from the commitments in these Terms and your order, the Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12Limitation of liability
To the fullest extent the law allows, Kre8ivHosting is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, even if we were told they were possible. Our total liability for any claim relating to the Services is limited to the amount you paid us for the affected service in the 12 months before the claim arose.
13Indemnification
You agree to defend and hold Kre8ivHosting harmless from third-party claims that arise from your content, your use of the Services, or your breach of these Terms.
14Changes to these terms
We may update these Terms as our Services or the law change. We will post the new version here with a new effective date, and email you at least 30 days before a material change takes effect. Continuing to use the Services after that date means you accept the updated Terms.
15Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Bexar County, Texas, and both parties agree to those courts' jurisdiction.
